Iowa Workers’ Compensation Commissioner – Garrett A. Lutovsky
Claimant alleged she was an employee of a company selling life insurance policies when she was injured in her first week during a training period. The Deputy Commissioner found Claimant to be an employee on the date of accident, and awarded her workers’ compensation benefits. On appeal to the Iowa Workers’ Compensation Commissioner, the decision was reversed and Claimant was found to be an independent contractor rather than an employee, so no benefits were awarded.
