Claimant alleged a permanent aggravation of a pre-existing mental health injury resulting from an incident with his supervisor where some physical contact was made. The parties greatly disputed the extent of any physical contact, but Claimant did not allege a physical injury resulting from the incident. The Deputy Commissioner agreed with Defendants’ argument that regardless of the theory of recovery, Claimant had not proven that the alleged aggravation was causally connected to his work. An order was entered that Claimant shall take nothing from the proceedings.
